How a judge applying the liberal assumptions behind the criminal justice system would understand the use of chemical agents by police when removing protestors
We will watch the documentary This is What Democracy Looks Like in class. For this written assignment, select one of the following events portrayed in the documentary: (1) The use of chemical agents by police when removing protestors from a sit-in on the road during the WTO meeting in Seattle; OR (2) Arrests of non-violent protestors during the WTO meeting in Seattle and the interaction between the protestors and their lawyers at the end of the film Write a paper explaining how a judge applying the liberal assumptions behind the criminal justice system would understand the example you’ve selected, with special attention given to the actions of the police. Who would the judge seek to protect and why? How do the actions of the police affect the state’s legitimacy? The idea is to demonstrate that you understand how the liberal assumptions built into the criminal justice system play out in particular examples. You are not being evaluated on your opinion of each example; you are being evaluated on your ability to explain how the criminal law applies and why the assumptions built into the law lead to particular results. Your answer must be no longer than 4 double-spaced pages of text, using 12 point Times New Roman font and one inch margins. Your ability to demonstrate your understanding and make a strong argument will be negatively affected by poor grammar, sentence structure and spelling, so proof read your answer carefully.
