To help you respond to the task, read the resources and discuss Health Law and human rights in your response putting case study at centre.

You may also analyse the case in the context of your own state (NSW, Australia) – laws differ by state, so you can research the law in your state as it pertains to this particular state before responding to the task.

Here is hypothetical case study 1:

Marvin, a 51 year old married father of three teenagers with a recent history of severe headaches is admitted unconscious and fitting following a fall. On arrival at the hospital he was placed in an induced coma & now appears comfortable. Subsequent scans show that he has a very large, aggressive tumour and this likely caused his headaches, fall and fitting. His prognosis is very poor and doctors think he has only hours or days left to live. His wife and teenage children arrive at the hospital. They would like him to be brought out of the coma so that he can be told he is dying and so that they can say their farewells. It is important to them that he knows they love him. They also state that it would be consistent with Marvin’s wishes as he is a devoted family man and has mentioned many times how important it would be to him to have an opportunity to say goodbye if something happened. If he is brought out of the coma, he is likely to experience suffering due to the seizures.
