(1) Question #1 – What are the differences between employees and independent contractors?  Please provide examples for each.  Is it possible for an employer to reclassify all of his employees as independent contractors? Explain why or why not.

(2) Question #2 – The employer makes the employee’s life miserable and the employee quits. What is this called? Is it legal? Does the employer’s burden of proof change between constructive and wrongful discharge?

(3) Question #3 – How do Title VII and its amendments protect employees? Are laws necessary to govern ethical treatment of employees? Explain why or why not.

(4) Question #4 – What is the relationship among statutes, regulations, and case law? Why is case law such an integral part of our legal system? How do decisions differ among various district courts? Provide examples.

(5) Question #5 – Celtec Industries terminated a manager at age 59, who later claimed the termination was based on age discrimination.  He attempted to show pretext with evidence that he was fired based on incorrect data (showing a deficit when his unit had actually performed within budget).  Is this sufficient?
